Don't Be The Victim of Termite Prevention Fraud

The Blog Post will focus on Termidor - one of the most popular termiticides on the market. BASF manufactures Termidor - and it is our opinion that, when applied correctly and properly maintained, it really works.

Understanding Termidor’s Efficacy and Legal Implications: Insights from Cochran Bowers PC

At Cochran Bowers PC, we specialize in representing clients in disputes against termite prevention companies. A significant focus of our practice is on the efficacy of termite treatments and the legal obligations of companies to provide services that meet regulatory minimum requirements. In this context, we turn our attention to BASF’s Termidor Pledge and its implications for both consumers and service providers.

The Popularity and Mechanism of Termidor

Termidor is a chemical called a termiticide that, when used properly can prevent termites from ever attacking your home.  Termidor is a widely recognized name in termite prevention, known for its effectiveness in protecting structures from termite damage. Its popularity is due in part to its active ingredient, fipronil, a phenylpyrazole chemical that disrupts the central nervous system of insects1. When applied correctly, Termidor creates a non-repellent barrier that is undetectable to termites. Non-repellant means that, as termites attempt to pass through this barrier, they quickly die.2.

The Termidor Pledge and Industry Participation

The Termidor Pledge is a commitment by BASF, offering a 10-year assurance plan for structures treated with Termidor products. This pledge includes the cost of re-treatment chemicals and labor should a Termidor-treated structure require additional treatment3. Despite the program being free for commercial applicators, some of the largest termite prevention companies do not participate. Why might this be?

Label Compliant Treatments: A Legal Requirement

Our investigations have found that non-participation may stem from the termite company’s failure to perform label compliant treatments. The label is the law when it comes to pesticide application. For a treatment to be effective and legally compliant, it must follow the specific instructions and guidelines set forth by the manufacturer and regulatory bodies. Failure to do so can result in gaps in the chemical barrier, which termites can exploit to gain access to a structure45.

The Importance of Compliance and Termite Behavior

Termites forage randomly and continuously, meaning any gap in a treatment barrier presents an opportunity for infestation6. The USDA and forestry association field tests require 100% efficacy for at least five years for all registered termiticides, including Termidor7. This standard underscores the importance of thorough and compliant application practices. Sadly, Cochran Bowers PC has found that some of the largest co-called termite prevention companies routinely fail to apply the termiticide chemicals to the label requirements, then allow the little chemical that they do apply to wear off without replacing it, all while actively concealing these material facts from their customers.

Legal Recourse for Property Owners

If your property has suffered termite damage, it is crucial to determine whether you received the protection you were promised and paid for – the protection that is required by the law – or were you the victim of fraud. At Cochran Bowers PC, we have the experience to navigate these complex matters and can help you understand your legal options.

Conclusion

Termite prevention is not just a matter of property maintenance; it is a highly regulated legal obligation for termite companies providing these professional services. If you learn that home has been damaged by termites, we encourage you to reach out for a free consultation. Our experienced team is ready to assist you in ensuring that your rights are upheld.
